This DPF notice (“Notice”) governs Guidde Inc (“Guidde”, “We” or “Our”) participation in the EU-U.S. DPF and the Swiss-U.S. DPF programs with respect to the Processing of Personal Data as further explained in Section 1 below. If there is any conflict between the terms in this Notice and the DPF principles, the DPF principles shall govern. To learn more about the DPF and its principles please visit https://www.dataprivacyframework.gov/s/.“Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. “Process”, “Processing” means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
2. PURPOSES OF DATA PROCESSING. Guidde complies with the principles of the EU-U.S. DPF, EU-U.S. DPF, and the Swiss-U.S. DPF regarding the collection, use, and retention of Personal Data transferred to the United States from the European Union, and Switzerland. Guidde is a generative AI platform that lets customers create videos and visual documentation in seconds for its employees and users (including, to edit the videos in third party platforms), and Guidde uses the Personal Data in the following cases: (i) to provide Guidde’s services; (ii) for Guidde’s customers to be able to use Guidde’s services; and/or (iii) to comply with other documented reasonable instructions provided by Guidde’s customers (the “Service”). The categories of Personal Data collected and Processed by Guidde, include, without limitation: Full name; username / log-in details; email address; title / job position; IP address; Geolocation information; videos, recordings and/or audios uploaded or generated by the customers; User ID (random number generated by the Service); Correspondence and telephone calls between Guidde and its customers; Cookie data; and/or any other Personal Data or information that the Guidde’s customers provide or instruct Guidde to Process in the context of Guidde’s Services. 3. ONWARD TRANSFERS OF PERSONAL DATA.
3.1 We will not transfer Personal Data originating in the EU, and/or Switzerland to third parties unless such third parties have entered into an agreement in writing with us requiring them to provide at least the same level of protection to the Personal Data as required by the Principles of the EU-U.S. DPF, and the Swiss-U.S. DPF. We transfer Personal Data to processors, service providers, vendors, contractors, partners and agents (collectively "Processors") who need the information in order to provide services to or perform activities on Our behalf. We are responsible for such onward transfers to third pursuant to the EU-U.S. DPF, and the Swiss-U.S. DPF.
